(وإن جَرَحه وهو مسلم، فارتدَّ، أو بالعكس) بأن جرحه وهو مرتد، فأسلم (ثم جَرَحه جرحًا آخر، ومات منهما، فلا قِصاص فيه) لأن أحد الجرحين غير مضمون، أشبه شريك المخطئ.
