(إلا أن يكون) الكافر (قتله) أي: المسلم (وهو حربيٌّ، ثم أسلم، فلا يُقتل) لقوله تعالى: {قُلْ لِلَّذِينَ كَفَرُوا إِنْ يَنْتَهُوا يُغْفَرْ لَهُمْ مَا قَدْ سَلَفَ}؛ ولأنه - صلى الله عليه وسلم - لم يقتل قاتل حمزة .
