(ويُقتلُ الذمي بالذمي، حر أو عبد، بمثله (٢) ) أي: الحرُّ بالحرِّ والعبدُ بالعبدِ؛ لما تقدَّم. (و) يُقتل (ذميّ بمُستأمَن، وعكسه) فيُقتل المُستأمَن بالذِّمي (ولو مع اختلاف أديانهم) فيُقتل النصراني باليهودي
