(ولو قتل من يعرفه) أو يظنه (ذميًّا عبدًا، فبان أنَّه قد أسلم وعتَق، فعليه) أي: القاتل (القِصاص) لأنه قَتَلَ من يكافئه عمدًا محضًا بغير حَقٍّ، أشبه ما لو علم حاله
