(ويجب أن تكون الآلة) التى يُستوفى بها القِصاص (ماضية) لحديث: "إذا قَتلتم فأحسنوا القِتْلة" (وعلى الإمام تفقّدها) أي: آلة الاستيفاء؛ لأن منها ما لا يجوز الاستيفاء به
