(وإن كان) الحق في (الاستيفاء لجماعة) بأن كان الوارث اثنين فأكثر (لم يجز أن يتولاه جميعهم) لما فيه من تعذيب الجاني وتعدُّد أفعالهم (وأمروا بتوكيل واحد منهم أو من غيرهم) ليستوفي القِصاص لهم
