(وإن قطع) الجاني (بعضَ أعضائه) أي: المجني عليه (ثم قَتَله بعد أن برئت الجراح، مثل أن قطع) الجاني (يديه ورجليه، فبرئت جراحته، ثم قتله) الجاني (فقد استقر حكم القطع بالبرء (ولولي القتيل) وهو وارث المجني عليه
