(فإن قال) وليُّ الجناية: (عفوتُ عن الجناية وما يحدُثُ منها؛ صَحَّ) العفو؛ لأنه إسقاط للحق بعد انعقاد سببه (ولم يضمن) الجاني (السراية) للعفو عنها.
