كشاف القناعal-Buhuti

(وإن وجب لعبدٍ قِصاص) في الطرف (أو تعزيرُ قَذْف، فله) أي: العبد (طلَبه والعفو عنه) لأنّه مختصّ به، والقصد منه التشفي (وليس ذلك للسيد) لأنه ليس بحق له (إلا أن يموت العبد) فينتقل إليه، وحينئذ فله طلبه وإسقاطه، كالوارث.
