(وإن شَلَّ) بفتح الشين، وقيل بضمها، أي: فسد العضو وذهبت حركته بالسراية (ففيه ديته دون القِصاص) لعدم إمكان القِصاص في الشلل، فيضمن بما يضمن به، كما لو لم يكن معه قطع.
