(وسرايةُ القَوَد غيرُ مضمونة) لما روي سعيد أن عُمر وعليّ بن أبي طالب قالا: "من مات من حدٍّ أو قصاصٍ لا دية له، الحَقُّ قَتَلَهُ"؛ ولأنه قطعٌ مستحَق فلا تضمن سرايته، كقطع السارق، ولا فَرْق بين سرايته إلى النفس أو ما دونها.
