(وإن كان) الضارب (موسِرًا، سرى العتقُ إليها وإلى جنينها) وعليه ضمان نصيب شريكه من الجنين بنصف عُشْر قيمة أُمه، ولا يضمن أُمه؛ لأنه قد ضَمِنها بإعتاقها، فلا يضمنها بتلفها.
