(وإن أقرَّ) بالضرب (أو ثبت ببينة أنه ضَرَبها، وأنكر إسقاطَها، فقوله -أيضًا- مع يمينه: إنه لا يعلم إسقاطَها) لا على البتِّ؛ لأنه يمين على فعل الغير، والأصل عدمه.
