(وإن قتل مسلمٌ كافرًا كتابيًا، أو غيره، حيث حُقِنَ دمُهُ) بأن كان له أمان (عمدًا، أضعِفَت الدية على قاتله لإزالة القود) لأن المسلم لا يقتل بالكافر، والقود شُرع زجرًا عن تعاطي القتل، حكم به عثمان كما رواه أحمد .
