(فإن كان المشتري) للجاني (عالمًا بحاله) أي: بأنه جنى جناية تعلَّق أرشُها برقبته (فلا خيار له) لدخوله على بصيرة (وينتقل الخيار في فدائه وتسليمه إليه، كالسيد الأول) لأنه مالكه إذن.
