(وخطأُ الإمام والحاكم في أحكامهما في بيت المال) لأن خطأه يكثُرُ فيجحف بعاقلته؛ ولأنه نائب عن الله، فكان أرْش جنايته في مال الله (كخطأ وكيل) فإنه على موكّله، يعني أن الوكيل لا يضمنه
