(وخطؤهما الذي تحمله العاقلة) هو خطؤهما في غير حكمهما (وشِبْهُه) أي: شِبْه الخطأ، إذا كان (في غير حكم على عاقلتهما) أي: الإمام والحاكم، كخطأ غيرهما.
