(وكذا إن كان) القتل (خطأً أو شِبْهَ عمدٍ) لم يُقسموا إلا على واحد معين، كالعمد (إن قلنا تجري فيهما) أي: الخطأ وشِبْه العمد (القَسامة) وهو قول غير الخرقي، وهو المذهب، وجزم به المصنف قريبًا. فصل
