(وارتدَّ، و) مثل أن (سرق وقطع يدًا) من مكافئ عمدًا (فَيُقطع لهما، ويُقتل لهما) لأن محل الحقين واحد، فتداخلا. (وإن عفا وليُّ الجناية) عن القِصاص (استُوفي الحدُّ) كما لو لم يعفُ.
