(ومن وطئ امرأته ولو) كانت (كتابية في قُبُلها وطئًا حصل به تغييب الحشفة، أو قَدْرها) من مقطوعها (في نكاح صحيح، وهما) أي: الزوجان (بالغان عاقلان حُرَّان ملتزمان، فهما محصَنان) يُرجم مَن زنى منهما بشروطه، ودخل في الملتزمين الذميان، وإنما يُعتبر ذلك في لزوم الحَدِّ، لا في حصول الإحصان، بدليل قوله كغيره:"ويثبت لمستأمنين".
