(لا) يقطع إن ملكه السارق ببيع، أو هبة، أو غيرهما (قبل رفعه) أي: السارق للحاكم؛ لقوله - صلى الله عليه وسلم -: "هلَّا كان قبل أن تأتيني به" و (لتعذُّر شرط القطع، وهو الطلب.
