كشاف القناعal-Buhuti

(ويقطعان) أي: الذمي والمستأمن (بسرقة ماله) أي: المسلم؛ لأنه إذا قُطع المسلم بسرقه مالهما، فَلأَنْ يُقطعا بسرقة ماله بطريق الأولى، و (كَقَوَدٍ، وحَدِّ قَذْفٍ) نصَّ عليهما (وضمان مُتلَف) مالي، وأرش جناية عليه.
