(فإن كانت العينُ في يده) أي: يد المُقِر بالسرقة، أو يد من شَهِدت البينةُ عليه بالسرقة (أخذها الحاكمُ، وحَفِظها للغائب) لأن الحاكم له النظر في مال الغائب، وعليه حفظه.
