(فإن أقرَّ) مُكلَّف (بسرقه مالٍ غائبٍ، أو شهدتْ بها بينةٌ؛ حُبِس) إلى قدوم الغائب (ولم يُقطع حتى يَحضُرَ) الغائبُ، ويطالب، وتعاد الشهادة؛ لأنه لا يكتفى بإقامتها قبل المطالبة.
