(وإن أقرَّ) مُكلَّفٌ (أنه سرق) نِصابًا (من رجلين) مثلًا (فصَدَّقه أحدُهما) وحده (أو حضر أحدُهما فطالب، ولم يطالب الآخرُ؛ لم يُقطع) لعدم كمال الشرط، وهو مطالبة المسروق منه بنصاب تام. ومفهوم كلامه في "الشرح": أنه لو كان المسروق من المدعى يبلغ نصابًا، قُطِع؛ لاجتماع الشروط.
