وإن كان مباح الدم كالحربي والمرتد والزاني المحصن حل قتله وأكله وكذا بعد موته:

(وإن كان) الآدميُّ (مُباحَ الدم كالحربي، والمرتد، والزاني المُحصَن) والقاتل فِي المحاربة (حَلَّ قتلُه وأكله) لأنه لا حُرمةَ له، فهو بمنزلة السباع. (وكذا) للمضطر أكلُه (بعد موته) لعدم حُرمته.
