(وكذا لو رأى قَطيعًا، فَسمَّى وأخذ شاةً) من القطيع (فذبحها بالتسمية الأولى) لم تُبح؛ لأنه لم يقصِدها بالتسمية (ولو جهل عدمَ الإجزاء) فلا يُعذر بالجهل، كما لو أكل في الصوم جاهلًا.
