(فإن مشى) الصيدُ (بها) أي: بالشبكة (على وَجْهٍ لا يقدِرُ على الامتناع، فهو لصاحبها) لأنه أزالَ امتناعه (كما لو أمسكه الصائد وثبتت يدُه عليه، ثم انفلت منه) فإن ملكه لا يزول عنه بانفلاته.
