كشاف القناعal-Buhuti

(وإن كان الحق عينًا) من وديعة وعارية ونحوهما، وحلف: لا يفارقه حتى يوفيَها له (فوهبها له الغريم) أي: مالكها (فقبِلها) الحالف (حَنِثَ) لأن البر فاته باختياره؛ لتوقفه على القَبول، بخلاف الدَّين.
