(وإذا اعتدل عنده قولان من غير ترجيح) أي: وكان من أهل الاجتهاد (فقال القاضي: يُفتي بأيهما شاء) وتقدم : ليس لمن انتسب لمذهب إمام أن يتخير في مسألة ذات قولين.
