(ومع غَيْبَةِ خَصْمِه يَبْعثُ إليه) ليحضر، فينظر بينهما (ومع جَهْلِه) أي: الخصم (أو تأخُّره بلا عُذْرٍ، يُخلَّى) سبيله (والأولى) أن يكون ذلك (بكفيلٍ) لأن الظاهر حبسه بحقٍّ.
