(ولو سأل المُدَّعِي إحلافَه) أي: المدعى عليه (ولا يُقيم البينةَ، فحلَفَ، كان له) أي: المدعي (إقامتُها) لأن البينة لا تبطل بالاستحلاف، كما لو كانت غائبة عن البلد.
