(فإن نَكَل) المُدعِي عن اليمين (قُضي عليه بنكوله، وصُرِف (٢) ) المدعى عليه؛ لأنه مُنكِر توجهت عليه اليمين، فنكل عنها، فحكم عليه بالنكول، كما لو كان مدعىً عليه ابتداء.
