(وإن رضيا بقَسْمه) أي: الماء (مُهَايأة بالزمان) كيومٍ لهذا، ويوم لهذا، جاز؛ لأن الحقَّ لهما، وكالأعيان (أو) تراضيا على قسمه (بمزاز، بأن يُنصب حجرٌ مستوٍ، أو) ينصب (خشبة في مصدم الماء، فيه) أي: الحجر، أو الخشبة (ثقبان على قَدْر حقيهما، جاز) لأن ذلك طريق إلى التسوية بينهما، فجاز، كقسم الأرض بالتعديل.
