(وإلا) أي: وإن لم يشترط في القسمة الرضا، أو اشترط ولم يوجد بعد القُرعة (فهو) أي: القاسم الذي نصباه (كقاسم الحاكم) فيكون القول قول المُنكِر، إلا أن يقيم المُدَّعِي بينةً بدعواه، فيعمل بمقتضاها.
