(وإذا تقاسموا) بأنفسهم، أو بقاسمٍ نصبوه، أو الحاكم (ثم استُحق من حصة أحدهما شيء مُعيَّن) أي: ظهر استحقاقه لغيرهما (بَطَلَتِ) القِسمة؛ لفوات التعديل.
