(ولا يرجع) أحدُ الشريكين على الآخر (به) أي: بشيءٍ من ذلك، إذا خرج نصيبه مستحقًّا، وقلع غراسه وبناءه (في قِسمةِ إجبارٍ) لأن شريكه لم يغرَّه، ولم تنتقل إليه من جهته ببيع، وإنما أفرز حقَّه مِن حقِّه، فلم يضمن له مما غرمه شيئًا.
