كشاف القناعal-Buhuti

(وإن خرج في نصيب أحدهما عيبٌ، فله فسخُ القِسمة إن كان جاهلًا به) أي: العيب (وله الإمساكُ مع الأرش) للعيب؛ لأن ظهور العيب في نصيبه نقصٌ، فخُيِّر بين الأرْش والفسخ، كالمشتري.
