(وإن سأل المُدَّعَى عليه الحاكمَ كتابة مَحْضَر بما جرى؛ أجابه) إليه وجوبًا (وذكر) الحاكم (فيه) أي: المحضر (أنه بَقَّى العينَ بيده؛ لأنه لم يثبت ما يرفعها) أي: اليد عن العين.
