(ولو تنازعا دابةً أحدُهما راكبُها، أو) أحدُهما (له عليها حِمْلٌ، والآخر آخذٌ بزِمَامِها، أو) الآخر (سائقُها، فهي) أي: الدابة (للأول) بيمينه، وهو الراكب، أو صاحب الحِمْل؛ لأن تصرُّفَه أقوى، ويدُه آكد، وهو المستوفي لمنفعة الدابة.
