(وإن أخذها) أي: العين المتنازَع فيها (المُقَرُّ له، فأقام) المُدَّعِي (الآخر بينةً) أنها له (أخذها) لترجُّحه (وللمُقَرِّ له قيمتها على المُقِرّ) قاله في "الروضة" ولم يُعرف لغيره؛ ذكره في "شرح المنتهى" وتقدَّم ما فيه.
