(وإن عُلِم موتُه في أحد الشَّهرين) وهما المُحرَّم وصَفَر، ولم يُعلم عَيْنُه (أُقرع بينهما) للعلم بموجِب عِتْق أحدهما، ولا مُعيِّن له غير القُرعة، فمن قَرَع عَتَقَ.
