(وإن لم يُعرف) أصل دِيْنه (فالميراث للكافر إن اعترف المسلم أنه أخوه، أو قامت به) أي: بأنه أخوه (بينةٌ) لأن المسلم لا يُقِرُّ ولده في دار الإِسلام على الكفر، فصار معترفًا بأن أباه كان كافرًا مُدَّعيًا إسلامه، وأخوه يُنْكِره، والقول قول المُنكِر
