(وإلا) أي: وإن لم يعترف المُسلِم بأخوَّة الكافر، ولم تَقُمْ بها بينة (فـ) الميراث (بينهما) لتساويهما في الدعوى مع عدم المُرجِّح، أشبه ما لو تنازعا عينًا في يديهما.
