(وإن شَهِد) الشاهد (بسببٍ يوجب الحقَّ) كتفريطٍ في أمانة، أو تعدٍّ فيها (أو) شهد بـ (ـاستحقاقٍ غيره) أي: غير ما يوجبه السبب، بأن قال: إن هذا يستحق في ذِمّة هذا كذا (ذَكَرَه) أي: اشترط ذكر الموجب للاستحقاق؛ لأنه قد لا يعتقده الحاكم موجبًا.
