(وتصحُّ شهادةُ فَرْعٍ على فَرْعٍ بشرطه) من التعذُّر والاسترعاء وغيرهما؛ لأن الحاجة تدعو إِلَى ذلك. (و) الشرط الرابع: دوام تعذُّر شهود الأصل إِلَى صدور الحكم.
