(وإن قالوا: أخطأنا، فعليهم دية ما تَلِف) مخفَّفة؛ لأنه خطأ، وتكون فِي أموالهم؛ لأنه بإقرارهم، والعاقلة لا تحمله (أو أرْشُ الضَّرْب) إن كان الحد جَلْدًا، أو حصل به نقص (وتقدم (٣) ذلك مستوفىً فِي كتاب الجنايات.
