(فإن لم يكن للميت تَرِكة) أو كانت واستغرقها ما ثبت بالبينة، أو إقرار الميت (لم يلزمهم شيءٌ) لأنهم لا يلزمهم دَيْنُهُ إذا كان حيًّا مُفلِسًا، فكذا هنا إذا كان ميتًا.
