(وإن ادَّعى رجلان دارًا في يد ثالثٍ أنها شَرِكة بينهما بالسوية، فأقرَّ) الثالث (لأحدهما بنصفها، فـ) النصف (المقَرُّ به بينهما نصفين) لاعترافهما أنَّ الدار لهما مُشاعة، فالنصف المقَرُّ به بينهما كالباقي، سواء أضافا الشركة إلى سبب واحد كإرث وشراءٍ أوْ لا.
