(ولا بأس بعلو مأموم، ولو) كان علوه (كثيرًا، نصًا) ولا يعيد الجمعة من يصليها فوق سطح المسجد. روى الشافعي عن أبي هريرة "أنه صلى على ظهرِ المسجدِ بصلاةِ الإمامِ" (١) ورواه سعيد عن أنس (٢) ، ولأنه يمكنه الاقتداء، أشبه المتساويين.
